the use or/and the inability to use the service or/and for cost of procurement
of substitute goods or/and services or resulting from any goods or/and data
or/and information or/and services purchased or/and obtained or/and messages
received or/and transactions entered into through or/and from the service
or/and resulting from unauthorized access to or/and alteration of user's
transmissions or/and data or/and arising from any other matter relating to the
service, including but not limited to, damages for loss of profits or/and use
or/and data or other intangible, even if Company has been advised of the possibility of such damages.
User further
agrees that Company shall not be liable for any damages arising from
interruption, suspension or termination of service, including but not limited
to direct or/and indirect or/and incidental or/and special consequential or/and
exemplary damages, whether such interruption or/and suspension or/and
termination was justified or not, negligent or intentional, inadvertent or advertent.
User agrees
that Company shall not be responsible or liable to user, or anyone,
for the statements or conduct of any third party of the service. In sum, in no
event shall Company's total liability to the User for all damages or/and losses
or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.
DISCLAIMER OF
CONSEQUENTIAL DAMAGES
In no event shall Company or any parties,
organizations or entities associated with the corporate brand name us or
otherwise, mentioned at this Website be liable for any damages whatsoever
(including, without limitations, incidental and consequential damages, lost
profits, or damage to computer hardware or loss of data information or business
interruption) resulting from the use or inability to use the Website and the
Website material, whether based on warranty, contract, tort, or any other legal
theory, and whether or not, such organization or entities were advised of the
possibility of such damages.
Gift Card Terms
& Conditions
The following terms and conditions are applicable to the
entity procuring Gift Cards through Aromaance.com:
1.
All Gift Cards shall be valid for a period as per the terms
decided and set out by www.aromaance.com.
2.
The Gift Cards is only redeemable on the www.aromaance.com websites
and set out in the respective Gift Card terms and conditions.
3.
The Aromaance guidelines and other terms and conditions of the
Gift Card, if any, of the Gift Card issuing entity, that shall be adhered to.
4.
The customer should be aware, understands and acknowledge that
the Gift Cards cannot be exchanged for its value in cash, either in full or in
part. The Company further acknowledges that the value stored/loaded in a Gift
Card cannot be refunded or cannot be transferred in any manner whatsoever.
5.
Under no circumstances whatsoever, is the return of Gift Cards
permitted under this Agreement..
6.
Aromaance will issue "Bill of Supply" or
"Invoice" for sale of Gift Cards as Gift Cards are not subject to GST
as per current tax law. Aromaance will raise the Tax invoice in case of Taxable
services/products billed along with the supply of the Gift Cards.
7.
In the event the Gift Card is procured by a customer, Aromaance
is required to maintain the beneficiary details of all customers who procure Gift
Cards and all beneficiaries who receive and/or redeem the Gift Cards for a
minimum period of 5 years (first name and last name of the beneficiary, email
id and phone number). This information is to be maintained as mandated under
the provisions of the Prevention of Money Laundering Act, 2002, the rules
notified thereunder and the Reserve Bank of India (RBI) guidelines on Anti
Money Laundering and in view of the Policy Guidelines for issuance and operation
of Prepaid Payment Instruments in India issued by RBI and other ancillary
applicable law. The Company also undertakes to share such beneficiary details
whenever requested by Aromaance.com/Reserve Bank of India/or any other
regulatory authority.
